EEO-1 Reporting Requirements

The employer information EEO-1 form is also known as standard form 100. This is a report, filed with the Equal Employment Opportunity Commission (EEOC), mandated by Title VII of the Civil Rights Act of 1967, as amended by the Equal Employment Opportunity Act of 1972. The Act mandates all the employers with 15 or more employees to file EEO-1 report based on their federal contract activities of the workplace on an annual basis.

For maintaining consistency, economy, and uniformity, EEO-1 report (standard form 100) has been jointly developed by the Equal Employment Opportunity Commission (EEOC) and the Office of Federal Contract Compliance Programs (OFCCP), as a single form that meets the statistical needs of both programs.

As discussed earlier, the filing of EEO-1 is required by law; it is not optional. Under section 709(c) of Title VII, the Equal Employment Opportunity Commission may compel an employer to file this report by obtaining an order from the United States District Court.

First-tier subcontractors and federal government contractors with 50 or more employees and at least $50,000 in contracts must file this EEO-1 report as well.

According to the Section 209(a) of Executive Order 11246, the penalties for not filing this report by a federal contractor or subcontractor to comply may include termination of the federal government contract and debarment from the future federal contracts.

An employer can file EEO-1 report within the period of October to December and must be filed by March 31st of the following year.

There are certain requirements for filing the EEO-1 report. Here, are some of the  EEO–1 Reporting Requirements for 2019.

Know Who Must File EEO-1 Report

(A) All private employers who are:

  • Subject to Title VII of the Civil Rights Act of 1964, as amended, with 100 or more employees EXCLUDING state and local governments, higher education institutions, primary and secondary public school systems, tax-exempt private membership clubs other than labor organizations and American Indian or Alaska Native tribes;
  • Subject to Title VII who have less than 100 employees, if there is centralized control, ownership, or management or the company is affiliated or owned by another company, so as to make sure that the group legally constitutes the whole enterprise that employees a total of 100 or more employees or a single enterprise.

(B) All federal contractors who:

  • have 50 or more employees;
  • are not exempt as provided for by 41 CFR 60-1.5;
  • are prime contractors or first-tier subcontractors;
  • are serve as depositories of Government funds in any amount;
  • have a subcontract, contract, or purchase order amounting to $50,000 or more;
  • are financial institutions which are paying or issuing agents for the U.S. Savings Bonds and or savings notes.

How to File

The reporting system is entirely online on the EEOC website including instructions that resolves all your queries and concerns.

First-time filers can find a simple registration form online as well. When registration is completed, the EEOC will issue a company number to the employer, and filers will be able to log into the system.
