Fair Housing Rights And Obligations

As per the Fair Housing Act, the Fair Housing rights and obligations include:

 

  • Advertising any preference, limitation, or discrimination because of race, color, religion, sex, handicap, familial status, or national origin, or intention to make such preference, limitation, or discrimination, is illegal.
  • Discriminatory advertising in additional categories like sexual orientation, gender identity, and source of income, is prohibited.
  • Advertisement for real estate that is in violation of the law is neither acceptable nor permitted. All dwellings advertised are available on an equal opportunity basis.

 

As a landlord, you have an obligation under the law 

 

  • Not to discriminate in the rental of property on the basis of race, color, religion, sex, handicap, familial status, or national origin.
  • Cannot instruct the licensed broker or salesperson acting as your agent to convey for you any limitations in the rental because the real estate professional is bound by law not to discriminate.
  • Cannot establish discriminatory terms or conditions in the rental, or deny that housing is available, or advertise that the property is available only to persons of a certain race, color, religion, sex, handicap, familial status, or national origin.

 

Agents in a real estate transaction are also prohibited by law from 

 

  • Discriminating on the basis of race, color, religion, sex, handicap, familial status, or national origin. 
  • Complying with a request from the landlord to act in a discriminatory manner in the lease or rental.

 

You as someone seeking to rent a property possess the right to expect  

 

  • That housing will be available to you without discrimination or other limitations based on race, sex, color, religion, handicap, familial status, or national origin. 
  • Equal professional service with the opportunity to consider a broad range of housing choices, no discriminatory limitations on communities or locations of housing, and no discriminations in the insuring of housing. 
  • Reasonable accommodations in rules, practices, and procedures for persons with disabilities, and to be free from harassment or intimidation for exercising fair housing rights.

 

Further, in many states and localities, you also possess the right to expect that housing will be available to you without discrimination based on additional classifications like a source of income. This indicates that a landlord cannot under any circumstances, refuse to rent to you or treat you less favorably just because you plan to use a subsidy or voucher to pay your rent.

 

All complaints alleging discrimination in housing may be filed with the nearest office of the United States Department of Housing and Urban Development (HUD), or by calling HUD’s toll-free number.
