What Are Employment Laws And Regulations?

The United States has more than 180 labor laws that govern workplace activities. The laws govern more than 10 million employers and almost 125 million employees. The laws cover all the areas related to employment such as leaves, wages, hours, and also hiring methods. These employment laws also cover complications, harassments, and workplace discrimination if any. No field is untouched by the labor laws and is applicable to each and every employer or employee. Here is a list of labor laws that is applicable in the US. 

 

Federal Employment And Labor Laws

  • The Fair Labor Standards Act: The law determines the minimum wages and overtime and half time pay of the labors along with child labor working hours.
  • The employee retirement income security act: The act does not apply to all private employers and also does not require all companies to offer the plans to workers. But if an employer chooses to offer the plans to their employees, the act helps to set them. 
  • Family medical and leave act: The act offers 12 weeks of unpaid annual leave to employees under certain circumstances. The circumstances can be the severe illness of any family member or self.

 

Laws Regulating Wages And Compensation

  • Compensatory time laws: The laws are applicable to circumstances where overtime pay is involved. 
  • Fair pay legislation: These laws are applicable for prohibiting discrimination on the basis of sex. Such as the equal pay act of 1963.
  • Minimum wage act: The act prescribes the minimum wage of any employee on the basis of his age, skills or experience.
  • Pay for snow days: The act basically covers the days when the organization is inoperative due to bad weather conditions. 
  • Vacation pay: Under the federal laws a company is not liable to pay wages to its employees for vacation time but some companies might still pay. The acts, therefore, regulate the same.

 

Hiring And Firing Laws

  • Employment at-will: Employment at the will of employers means that employers can fire their employees anytime, with or without reasons except for the discriminatory reasons. The acts, therefore, regulate the same. 
  • Terminated for a cause: The firing laws include reasons for firing an employee. It includes reasons like employees violating company’s policies or failing a drug test. These laws, therefore, keep a check on employee termination.
  • Unemployment laws: Some laws are applicable to employees to provide them with unemployment benefits to save them from a job loss that happened not because of the employee’s fault.

 

Labor Laws

There are various labor laws applicable to employees and also employers. Some of these laws are:

 

  • Employee retirement income security act: It sets laws or health and retirement plans for employees.
  • Fair credit reporting act: An employee can get knowledge about their legal protections under this act.
  • Fair labor standard act: The act regulates minimum wage, overtime wage and also child labor wage.
  • Child labor laws: It regulates the working hours of minors and the type of employment in which they must work.

Background check law: It regulates the employment background checks of the employees.
