Overtime calculation is one of the most misunderstood — and most heavily scrutinized — areas of payroll compliance. Employers face unique challenges when determining overtime pay for non-exempt employees, whether they are paid hourly, by piece rate, or on a salary basis. Payroll professionals must factor in commissions, bonuses, incentive pay, piece rates, shift differentials, multiple pay rates, and actual hours worked within a workweek. Each of these elements can directly impact the correct overtime rate — and small errors can quickly become costly.

Overtime pay is far more complex than simply multiplying an hourly rate by 1.5. Employers must correctly determine which employees qualify for overtime, calculate the “regular rate of pay” for salaried non-exempt workers, and properly include bonuses, incentives, and shift differentials in overtime calculations.
