ABOUT THE EVENT

2020 has been a tumultuous year.  COVID19 has resulted in unprecedented layoffs.  As many states began to lift restrictions to allow employees to return to work, the tragic death of George Floyd and others lead to widespread protests throughout the world.   Social media has exploded as individuals speak out.  Individuals are speaking out both on-duty and off-duty.  A number of employer concerns have arisen due to this free speech and has also raised the issue of what obligations employers have towards their employees during this time.  This webinar will walk you through some of those concerns.

Learning Objectives

  • Handling employees who participate in protests but don’t follow CDC guidelines of wearing masks or social distancing.
  • Balancing enforcement of dress codes and employees’ speech
  • Social media concerns
  • When speech becomes protected concerted activity under the National Labor Relations Act
  • Potential Title VII claims arising out of protests and speech
  • Sending the right message to employees
  • And more...

Susan Fahey Desmond

For more than 35 years, Susan Fahey Desmond has helped companies – hospitals, banks and credit unions, manufacturing companies, offshore oil companies, school districts, and others – minimize the cost and disruption of employment disputes. She defends wage and hour, wrongful discharge, non-compete, Family and Medical Leave (FMLA), and other claims. Clients seek her litigation counsel for age, sex, disability, race, religion, and sexual harassment discrimination lawsuits, as well as class actions. She helps employers dispute Equal Employment Opportunity Commission (EEOC) charges and other administrative complaints and navigate the administrative and judicial process. And, perhaps most importantly, she works with management and HR to resolve issues before they develop into contentious litigation.
