ABOUT THE EVENT

A recent court decision in New York invalidating important aspects of the Department of Labor’s rules on the Families First Coronavirus Response Act (FFCRA) has caused the Department of Labor to issue a final rule to revise regulations which would change some important provisions of the rules regarding the FFCRA. The district court in New York vacated four provisions of the FFCRA including the  “work availability” requirement, the “health care provider” definition, employer consent for intermittent leave for childcare reasons, and the requirement that documentation supporting the need for leave be submitted before the FFCRA leave is taken.  Based on the court’s holding on this, the Department of Labor sent a final rule to be reviewed by the White House on September 3, 2020, for approval.  These changes require employers to now make important revisions to their FFCRA policies and procedures. Melissa Fleischer, Esq

Ms. Fleischer is an adjunct faculty member with the Professional Development Center at SUNY/Westchester Community College in Valhalla, New York. She is a member of the Society for Human Resource Management (SHRM). Ms. Fleischer earned her J.D. degree from The George Washington University Law School in Washington, D.C., and her B.A., cum laude, from New York University.
