The Supreme Court recently agreed to hear three cases that may change the law of the land for many years to come. The lower courts have been split on an important issue that significantly impacts whether LGBTQ individuals are protected from discrimination under federal law, and in particular under Title VII. This issue is whether the protection from “sex” discrimination in Title VII includes discrimination based on sexual orientation and gender identity. The lower courts have split on this issue and next term the U.S. Supreme Court will decide this issue.

Ms. Fleischer is an adjunct faculty member with the Professional Development Center at SUNY/Westchester Community College in Valhalla, New York.
