ABOUT THE EVENT

On April 29, 2024, the EEOC released its first major update to workplace harassment enforcement guidance in 25 years. The guidance reflects new legal developments, including Supreme Court rulings extending anti-discrimination protections to LGBTQ workers. While not legally binding, it provides the EEOC’s interpretation of harassment standards and employer liability under federal EEO laws and replaces several prior guidance documents.

The EEOC emphasizes that workplace harassment goes beyond sexual harassment and includes conduct based on race, sex, religion, and other protected characteristics. Harassment remains a serious issue, accounting for over one-third of EEOC charges in recent years.

The guidance explains the three parts of a harassment claim:

  1. Protected basis and causation
  2. Impact on a term or condition of employment
  3. Employer liability

Whether conduct is unlawful depends on the totality of the circumstances and whether it is linked to a protected characteristic.

Margie has created and presented seminars/webinars for many compliance institutes. These national training providers, offer compliance training to professionals, business owners and companies interested in having their company compliant with workplace and industry regulations.

Margie holds professional human resources certification (PHR) from the HR Certification Institution (HRCI) and SHRM-CP certification from Society for Human Resources Management. Margie has completed the Certified Compliance and Ethics Professional training and is a member of the Society of Corporate Compliance & Ethics (SCCE).
