HUD and the DOJ are devoting more money and resources than ever to discover fair housing violations, Supported by local and national advocacy organizations, they have focused their attention on the rights of the disabled, sexual harassment and resident-on-resident disputes to a greater degree than ever before.

In addition, the increase in public education and enforcement has given rise to more awareness by the public of their rights and an increase in accusations of discrimination, harassment and retaliation.

This session will explore how to effectively comply with local and federal fair housing laws to minimize the possibility of being the subject of a complaint or law suit.

  • What is Disparate Impact and how does it inform our compliance program?
  • Why are there three laws (the FHAA, ADA and Section 504) protecting the rights of people with disabilities and what do I need to know about each?
  • What are the FHA/ADA definitions of “Accommodation”, “Modification”, “Reasonable”, “Necessary” and Nexus?
  • What is the most effective workflow for accepting, processing, and completing requests for accommodations and modifications?
  • What does the recent HUD guidance tell us about Assistance Animals and how to use the guidance to stay in compliance with the FHA.
  • Is a “Handicap Parking Space” the same as a reserved parking space for a reasonable accommodation?
  • What is HUD’s “Interactive Process” requirement and how to best implement it.
  • What different forms and other documentation is required and what can I require customers to complete?
  • What are our responsibilities regarding tenant-on-tenant harassment?
  • What constitutes retaliation and how do I avoid being accused of retaliating?

Doug Chasick

Doug Chasick, CPM®, CAPS, Adv. RAM, SLE, That Fair Housing Guy™, is the former President of the Fair Housing Institute, Inc. With more than 46 years of investment real estate experience, he began as the Resident Manager of a 524-unit apartment property and has been the President or CEO of five real estate companies, responsible for portfolios of over 28,000 apartments. Doug was awarded his CPM® in 1979 and was a member of the IREM National Faculty for eight years. A Senior Instructor member of the NAAEI Faculty, he leads the Advanced Facilitator Training course, is the co-author of “Outstanding Facilitation Techniques”, and a co-author of the joint IREM & NAAEI “Fair Housing and Beyond” course. He is a licensed Real Estate Broker in Florida, a licensed Expert Fair Housing Instructor in the Commonwealth of Virginia, and the recipient of the NAAEI Apartment Career & Education award.
