There are two types of discrimination – discrimination due to difference treatment and discrimination due to disparate impact. One is obvious, the other, subtle. This session will focus on how to identify – and avoid – discrimination due to different impact. We’ll explore the HUD three-step burden shifting process used to evaluate disparate impact claims and we’ll review strategies to minimize the possibility of being named in a complaint or lawsuit alleging discrimination due to disparate impact.

Areas Covered:

  • What is Disparate Impact Theory?
  • What is “Burden Shifting”?
  • Statistics vs Reality
  • Criminal Background checks
  • Source of Income
  • Victims of Domestic Violence
  • Occupancy Standards
  • Other Lease Qualifying Standards
  • Don’t Treat Everyone the Same

Learning Objectives:

  • Identify situations where discrimination due to disparate impact might occur.
  • Minimize the possibility of doing or saying something that could be characterized as discrimination due to disparate impact using policies, procedures, and training to heighten awareness of potential problem areas.
