HOTMA Final Rule Updates for Public Housing and HCV, Implementing Sections 102 & 104

The Housing Opportunity Through Modernization Act of 2016 (HOTMA) was enacted on July 29, 2016. Title I of HOTMA contains 14 sections that affect the public housing and Section 8 rental assistance programs. This final rule revises HUD regulations to put sections 102, 103, and 104 of HOTMA into effect. We will explore the updates particularly affecting income calculation, reviews, and program eligibility.   We will particularly discuss the new Public Housing over-income provisions in Section 103 that became effective March 16, 2023.
