{"id":822,"date":"2019-09-24T11:12:00","date_gmt":"2019-09-24T05:42:00","guid":{"rendered":"https:\/\/www.complianceprime.com\/blog\/?p=822"},"modified":"2019-09-24T11:12:00","modified_gmt":"2019-09-24T05:42:00","slug":"conform-yourself-with-form-i-9","status":"publish","type":"post","link":"https:\/\/www.complianceprime.com\/blog\/2019\/09\/24\/conform-yourself-with-form-i-9\/","title":{"rendered":"Conform Yourself With Form I-9"},"content":{"rendered":"<p><span style=\"font-weight: 400\">Before hiring a new employee, the employer has to verify that the person has the legal mandate to work in the U.S. The new hire has to demonstrate his or her eligibility to work in the U.S. It is the I-9 form that is used to verify a candidate\u2019s eligibility for employment in the U.S. The form is used by the U.S. Citizenship and Immigration Services to determine one\u2019s eligibility to stay and work in the USA.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">As the employer, you have to see to it that the employee completes this form and hands it over to you. You need to retain this form with your along with other employment records. Indeed, you need to conform yourself with form I-9.<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400\">Filling Out Form I-9\u00a0<\/span><\/h2>\n<p><span style=\"font-weight: 400\"><a href=\"https:\/\/www.complianceprime.com\/details\/354\/Form-I-9-Reporting-E-Verify\">Form I-9<\/a> seeks to obtain information from new recruits to see that they meet the requirements to live and work in the U.S. So, every worker has to complete this form.<\/span><\/p>\n<h2><span style=\"font-weight: 400\">Component of I-9 Form<\/span><\/h2>\n<p>&nbsp;<\/p>\n<h3><span style=\"font-weight: 400\">Part I:\u00a0 Establishing Identity<\/span><\/h3>\n<p><span style=\"font-weight: 400\">This is a part that has to be filled in by the employee, and it deals with establishing identity. It asks for full name of the employee and his or her date of birth and address\u00a0along with Social Security number\u00a0(in applicable cases), telephone number and email address.\u00a0 However, the phone number and the email address are optional.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400\">The employee has to assert that he is legally eligible to work in the U.S. since he\/she is:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">A citizen of the USA;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">A nonresident national of USA;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">A lawful permanent resident;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">A foreigner who is authorized to work in the USA. These employees have to enter the\u00a0date of expiration of their authorization, in cases where applicable. Such an employee also needs to enter the\u00a0<\/span><span style=\"font-weight: 400\">alien registration number<\/span><span style=\"font-weight: 400\">, a unique number assigned to foreigners. If this is not available, he or she has to fill the <\/span><span style=\"font-weight: 400\">Form I-94<\/span><span style=\"font-weight: 400\">\u00a0admission number.\u00a0<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400\">In the end, the employee has to put his or her sign and date on the form.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400\">Any false information in this part may lead to fines and\/or imprisonment.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400\">However, in case the employee has a disability or needs a translation from English to his or her language, the person who would be assisting the employee in completing the form has to enter his\/her address and name and also sign in the form. Moreover, this person also comes under penalty of perjury.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3><span style=\"font-weight: 400\">Part II:\u00a0Verification of Identity<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400\">This is a part that needs to be filled in by the Employer, and it involves a review of the documents submitted by the employee.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400\">Herein, the employer has to describe the documents submitted by the employee in order to verify the eligibility of the candidate. He has to do this within 3 days of his first day of employment. The employer can\u00a0also keep copies of the documents presented by the employee.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400\">There are three lists of documents to be submitted. The employer can go by any of these. The type of documents submitted by the employee must conform to the portion of Part <\/span><span style=\"font-weight: 400\">II.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3><span style=\"font-weight: 400\">Conclusion\u00a0<\/span><\/h3>\n<p><span style=\"font-weight: 400\">Conforming yourself to Form I-9 is not confined to submission of the documents by the employee.
