Americans with Disabilities Act, which became law back in 1990. Basically, it exists to stop discrimination against people with disabilities, in jobs, transportation, schools, and yes, buildings. Meaning the physical space, the way it\u2019s built, and whether it\u2019s actually usable by someone in a wheelchair, someone with low vision, or someone who depends on a service animal.<\/p>\n\n\n\n<p>When people say \u201cADA compliance\u201d in rental properties, they usually mean making sure that certain parts of your building or property are accessible to people with physical or mental disabilities. This can include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Wheelchair ramps (because stairs don\u2019t work for everyone)<\/li>\n\n\n\n<li>Wider doorways (for mobility devices to fit)<\/li>\n\n\n\n<li>Braille signs or audio alarms (for vision or hearing disabilities)<\/li>\n\n\n\n<li>Lowered countertops (so someone in a wheelchair can actually use the kitchen or reception)<\/li>\n\n\n\n<li>Grab bars in bathrooms<\/li>\n\n\n\n<li>Service or <a href=\"https:\/\/www.complianceprime.com\/blog\/2024\/03\/08\/are-emotional-support-animals-service-animals-under-ada\/\"><strong>emotional support animals<\/strong><\/a> being allowed even if you don\u2019t allow pets normally<\/li>\n<\/ul>\n\n\n\n<p>And the above list? That\u2019s just scratching the surface. There are way more things to think about. Because housing should be fair, period.<\/p>\n\n\n\n<p>Imagine a family of four trying to move out of a dangerous, rundown neighborhood into somewhere better, only to be told \u201cno\u201d, not because of their credit score or background check, but because the owner doesn\u2019t like the idea of people from that part of town. That\u2019s discrimination.<\/p>\n\n\n\n<p>Now, flip the script. A tenant who uses a wheelchair tries to rent your place, but you don\u2019t have a ramp, and you haven\u2019t thought about making your space accessible. That\u2019s also a problem. They have the right to live in a safe, accessible, welcoming environment, and so does their family.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Who Does ADA Actually Apply To?<\/strong><\/h3>\n\n\n\n<p>Here\u2019s where most landlords start getting confused, and I don\u2019t blame them, because the rules are not explained well.<\/p>\n\n\n\n<p>The ADA mostly applies to \u201cpublic accommodations.\u201d That means commercial spaces, retail shops, offices, restaurants, basically any place where the public can walk in.<\/p>\n\n\n\n<p>So if you&#8217;re renting commercial space, ADA rules definitely apply to you.<\/p>\n\n\n\n<p>Now, for residential properties, it\u2019s more nuanced. ADA doesn\u2019t apply to private homes the same way. You\u2019re not required to rip out your bathroom or redo your entire building just because someone might need it.<\/p>\n\n\n\n<p>But, there are situations where ADA does kick in for residential properties:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>You operate a leasing office that\u2019s open to the public<\/li>\n\n\n\n<li>You own a mixed-use property (like shops downstairs, apartments upstairs)<\/li>\n\n\n\n<li>You rent out public housing<\/li>\n\n\n\n<li>You&#8217;re a larger property owner or company that serves the public in a broader way<\/li>\n<\/ul>\n\n\n\n<p>So while individual apartments may not fall under ADA directly, the common areas, leasing office, and commercial zones likely do.<\/p>\n\n\n\n<p>Also, and this is where some landlords trip up, even if ADA doesn\u2019t apply, the Fair Housing Act (FHA) does. And the FHA also protects people with disabilities and requires you to make \u201creasonable accommodations.\u201d So either way, you\u2019ve got legal responsibilities.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>When Does a Property Have to Be ADA Compliant?<\/strong><\/h3>\n\n\n\n<p>If your building was built or altered after January 26, 1993, it must meet ADA standards. Simple as that.<\/p>\n\n\n\n<p>But what if your building is older? Then the law says: you still need to remove barriers if it\u2019s \u201creadily achievable.\u201d Meaning: if it\u2019s not too expensive or technically complicated, you should fix it.<\/p>\n\n\n\n<p>Installing a grab bar in a common bathroom? That\u2019s not going to break the bank. Adding a ramp where there are only three steps? Also doable. Completely tearing out and rebuilding your lobby with a new elevator? Okay, maybe not \u201creadily achievable\u201d, that\u2019s when you document why it\u2019s not possible and look for alternatives.<\/p>\n\n\n\n<p>But don\u2019t ignore it altogether. Even older buildings are expected to do what they can to improve accessibility.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Where Exactly Does ADA Apply Inside a Rental Property?<\/strong><\/h3>\n\n\n\n<p>Let\u2019s break it down:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Commercial Areas<\/strong>: Yes, 100%. Full ADA compliance needed.<\/li>\n\n\n\n<li><strong>Leasing Office<\/strong>: If it\u2019s open to the public (and it usually is), yes.<\/li>\n\n\n\n<li><strong>Common Areas<\/strong> in a multifamily building: Depends, but if the public uses them or if they serve multiple tenants (like laundry rooms, mailrooms, front entrances), ADA likely applies.<\/li>\n\n\n\n<li><strong>Inside private residential units<\/strong>: Usually not covered by ADA, but the FHA requires reasonable accommodations if requested.<\/li>\n<\/ul>\n\n\n\n<p>So don\u2019t assume you\u2019re off the hook just because it\u2019s \u201ca home.\u201d<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Why Bother with ADA Compliance?<\/strong><\/h3>\n\n\n\n<p>Here\u2019s the brutal truth: If someone with a disability tries to rent your property, and your space is clearly not accessible, you\u2019re not just \u201cmissing out\u201d on a tenant, you might be inviting legal trouble.<\/p>\n\n\n\n<p>They can file a complaint.&nbsp; Authorities can open an investigation.&nbsp; Your property might get inspected. You could be forced to make changes and pay fines on top of it.<\/p>\n\n\n\n<p>Even worse? Your reputation gets dinged. And not just among people with disabilities, but everyone. You don\u2019t want to be known as the landlord who discriminates, whether intentionally or through negligence.<\/p>\n\n\n\n<p>And also, from a business point of view, why would you want to limit your pool of potential tenants? A more accessible building = more people who can live there = fewer vacancies. Common sense.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>How Do You Actually Make Your Property ADA Compliant?<\/strong><\/h3>\n\n\n\n<p><strong>1. Start by understanding the rules<\/strong><strong><br><\/strong>Go online and look for the ADA Compliance Checklist. There are official versions at<a href=\"https:\/\/adata.org\/project\/ada-checklist\" target=\"_blank\" rel=\"noopener\"> <strong>ADA.gov<\/strong><\/a>, and there are also simplified versions that break it down room by room. This helps you figure out what you need to do based on when your building was built, what type of property it is, and what kind of space you\u2019re renting.<\/p>\n\n\n\n<p><strong>2. Do the changes<\/strong><strong><br><\/strong>Once you know what\u2019s missing, start taking action. Prioritize the basics: entryways, signage, bathrooms, light switches, door handles, height of things like counters and mailboxes. And remember, service animals are not pets, don\u2019t get this wrong. Even if you have a \u201cno pets\u201d policy, that doesn\u2019t apply to someone\u2019s guide dog or emotional support animal under certain conditions.<\/p>\n\n\n\n<p><strong>3. Talk to your tenants<br><\/strong>Don\u2019t wait around hoping nobody brings it up. Be proactive. <strong><a href=\"https:\/\/www.complianceprime.com\/blog\/2023\/06\/02\/do-landlords-have-to-adapt-to-a-disabled-tenants-needs-why-and-how\/\">Ask tenants if there\u2019s anything they need or if there\u2019s something that could help them live more comfortably<\/a><\/strong>.\u00a0 If someone makes a request for a change in their unit (like adding a ramp or adjusting a counter), consider whether it\u2019s \u201creasonable\u201d and don\u2019t delay your response. You\u2019re not expected to do everything, but you are expected to try.<\/p>\n\n\n\n<p><strong>4. Document everything<\/strong><strong><br><\/strong>Keep records of what you checked, what you fixed, what requests were made, and how you handled them.
