eviction, especially after the Tenant Protection Act (AB 1482) came into effect. A landlord can\u2019t just ask someone to leave because they feel like it. There has to be a legally valid reason, also known as &#8220;just cause.&#8221; Here are the most common ones:<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>1. Non-Payment of Rent<\/strong><\/h4>\n\n\n\n<p>This is the most straightforward reason. If a <a href=\"https:\/\/www.complianceprime.com\/blog\/2023\/11\/16\/what-to-do-if-the-tenant-is-not-paying-rent\/\"><strong>tenant stops paying rent<\/strong><\/a>, the landlord can issue a 3-day notice to pay or quit. If the tenant doesn\u2019t pay within that window, the landlord can proceed with the eviction process.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>2. However, the work must be substantial, not just painting or replacing carpets.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>7. Withdrawing the Property from the Rental Market<\/strong><\/h4>\n\n\n\n<p>Under the <strong>Ellis Act<\/strong>, a landlord can evict tenants if they are removing the property from the rental business entirely. This is often used when selling a building or converting it to another use, but the process is highly regulated and requires strict compliance.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>How to Evict a Tenant Legally in California<\/strong><\/h3>\n\n\n\n<p>Evictions in California must follow a very specific legal process. Skipping steps, or doing things informally, can land a landlord in serious legal trouble.<\/p>\n\n\n\n<p>Here\u2019s the correct way to handle it:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Serve the Correct Notice<\/strong><strong><br><\/strong>\n<ul class=\"wp-block-list\">\n<li>3-day notice to pay or quit (for unpaid rent)<\/li>\n\n\n\n<li>3-day notice to cure or quit (for lease violations)<\/li>\n\n\n\n<li>3-day notice to quit (for serious issues like illegal activity)<\/li>\n\n\n\n<li>30-day or 60-day notice to vacate (for no-fault evictions, depending on the circumstances)<br><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Wait Out the Notice Period<\/strong><strong><br><\/strong>Once the notice is served, the tenant must be given the legally required time to act, either by fixing the issue or leaving.<br><\/li>\n\n\n\n<li><strong>File an Unlawful Detainer Case<\/strong><strong><br><\/strong>If the tenant doesn\u2019t comply, the landlord must file an eviction lawsuit, known as an unlawful detainer, in court.<br><\/li>\n\n\n\n<li><strong>Go Through the Court Process<\/strong><strong><br><\/strong>The tenant may choose to fight the case. If so, a hearing will be scheduled. If the court rules in favor of the landlord, it will issue a judgment for possession.<br><\/li>\n\n\n\n<li><strong>Get a Writ of Possession<\/strong><strong><br><\/strong>The court then issues a writ of possession, which is enforced by the local sheriff. The sheriff, not the landlord, removes the tenant if necessary.<br><\/li>\n<\/ol>\n\n\n\n<p>A landlord is <strong>never allowed<\/strong> to change the locks, shut off utilities, or harass a tenant to force them out. That\u2019s called a \u201cself-help\u201d eviction, and it\u2019s illegal in California.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Conclusion<\/strong><\/h3>\n\n\n\n<p>California landlords need to understand this clearly: eviction is a serious process, not a quick fix.
