In fact, the law was enacted to discourage discriminatory practices by lenders, landlords, buyers, and renters of houses and dwelling units. It believes that every American has the right to purchase, rent or mortgage a home irrespective of skin color, sex, religion, nationality, etc. Yet, it is not a comprehensive act. style=\"font-weight: 400;\">Disability<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Pregnant women and those with minor children <\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Nationality<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Religion<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Race<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Sex<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-weight: 400;\">Classes And Properties Not Protected Under Fair Housing Act<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The act does not include every class and property. Certain classes and properties are outside the purview of the Act, and these are &#8211; <\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Single-family homes being put up for rent or sale without a broker<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Owner-occupied homes having four or less number of units<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Private organizations or clubs which are meant only for members<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Tenants using illicit drugs<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Housing meant for elderly people are protected for them only<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Tenants indulging in drinking and smoking <\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Aged people, since age is not a protected class under this act.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Nevertheless, despite these exemptions, the <\/span><a href=\"https:\/\/www.complianceprime.com\/details\/378\/Emerging-Trends-Fair-Housing-2019\"><b>Fair Housing Act<\/b><\/a><span style=\"font-weight: 400;\"> debars these families and homes, except member specific organizations, from making discriminatory statements while advertising their property by including discriminatory terms for any of the protected classes. <\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Avoiding Accusations of Discrimination While Selling Or Renting Out<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Selling or renting your house or dwelling unit while adhering to the principles of the <\/span><b>Fair Housing Act<\/b><span style=\"font-weight: 400;\"> can be tricky, even if you are exempt from the law. To ensure compliance you need to:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Be careful about what you say over the phone or in person while placing the rental ads.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Be careful while denying tenancy to someone or some people. You can legally deny a certain group or person because of poor credit, perceived inability to pay rent, etc.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Be careful while <\/span><a href=\"https:\/\/www.thebalancesmb.com\/the-complete-guide-to-tenant-screening-2125054\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">screening tenants<\/span><\/a><span style=\"font-weight: 400;\">. You need to invoke the same standard for everybody. So, ask for the same documents, information, fees, and referrals and go through the same practice for each\u00a0potential applicant for renting or selling your property.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Treat every applicant with dignity and respect.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Be careful about checking the local Fair Housing Law and ensure obedience to its nuances since some states include additional classes in the Act like sexual orientation, age, student status, etc.<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-weight: 400;\">Goal of the Fair Housing Act<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/www.complianceprime.com\/blog\/2019\/03\/31\/why-is-the-fair-housing-act-so-important\/\"><span style=\"font-weight: 400;\">goal of Fair Housing Act<\/span><\/a><span style=\"font-weight: 400;\"> can be summarised as s<\/span><i><span style=\"font-weight: 400;\">topping discrimination in home selling, renting<\/span><\/i><span style=\"font-weight: 400;\"> or mortgaging by any of the following means:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Refusing to rent, sell, or negotiate for a house<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Lying about the availability of houses <\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Incorporating discriminatory terms in selling or renting of homes<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Denying multiple listing or other housing-related services <\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Refusing a mortgage loan<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Incorporating discriminatory terms for loans like higher interest rates or additional fees<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Adopting discriminatory activities in property appraisal.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Making discriminatory statements while advertising for a property by adopting exclusionary terms for some of the protected classes. <\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Threatening\/interfering with fair housing right of any of the protected classes.<\/span><\/li>\n<\/ul>\n<h3><\/h3>\n<h3><span style=\"font-weight: 400;\">Conclusion<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Hope this article will tell you a clear picture of the goal under the Fair Housing Act and who is not protected under the Fair Housing Act.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Fair Housing act does not include every class and property.
